Who Can File a Wrongful Death Claim After a Fatal Crash in Milwaukee, WI?
In Wisconsin, the right to file a wrongful death claim after a fatal crash belongs to specific family members defined by state law. A spouse, domestic partner, or the deceased person’s children are typically the first eligible parties to bring a claim. If no spouse, partner, or children survive, parents of the deceased may be entitled to file.
Wisconsin wrongful death claims must generally be filed within three years of the date of death. The claim can seek compensation for the deceased person’s lost earning capacity, the loss of companionship and society suffered by surviving family members, funeral and burial costs, and related expenses.
When a driver is taken into custody following a fatal crash, the criminal process and the civil wrongful death claim run separately, a civil claim can proceed regardless of the outcome of any criminal proceedings.
A Milwaukee personal injury attorney can help surviving family members understand their standing, gather evidence from the crash, and build a claim that reflects the full extent of their loss.
