What Damages Can a Family Recover in a Wisconsin Wrongful Death Claim?

A family pursuing a wrongful death claim in Wisconsin can seek damages for medical and funeral expenses, loss of companionship, and loss of the deceased’s financial support, among other losses recognized under state law.

Wisconsin allows a spouse, child, or personal representative of the estate to bring a wrongful death claim, and the law sets a three-year deadline from the date of death to file.

Separately, a survival action can allow the deceased’s estate to recover for the pain and expenses she experienced between the crash and her death, which is treated as a distinct claim from the wrongful death action itself.

How much a family can recover typically depends on Wisconsin’s comparative negligence rule, which bars recovery entirely if the deceased was found more than 50% at fault for the collision.

While the investigation of an accident remains ongoing, gathering evidence, such as vehicle data, witness accounts, and the official crash report, can play a significant role in how a claim is evaluated.

A Milwaukee personal injury attorney can help a family collect this evidence early and work through how both the wrongful death and survival actions might apply to their situation.
