Wisconsin’s Rules on Recovering Damages for Life-Threatening Injuries in Milwaukee, WI
When a crash leaves someone with life-threatening injuries, the scope of a personal injury claim usually extends well beyond emergency room costs.
Life-threatening injuries can leave victims dealing with extended hospital stays, surgeries, and long-term rehabilitation, and if young adults face these injuries, they can be looking at years of ongoing medical care.
The financial impact isn’t limited to medical bills either, since lost future earning capacity can become a significant part of a claim when injuries are severe enough to affect someone’s ability to work long-term.
When it comes to fault determination, Wisconsin follows a modified comparative negligence rule. This means that an injured person is allowed to recover damages as long as they’re found less than 51 percent at fault for the crash.
When a crash leaves someone with critical injuries, it can lead to larger insurance payouts, and insurers tend to scrutinize fault more closely, which is where a Milwaukee personal injury attorney can help by pushing back on attempts to shift blame onto the injured party.
