WHAT EVERY DRIVER SHOULD KNOW

Pulled over? Here's what to do

You are driving down the road when, all of the sudden, the red and blue lights turn on behind you. Here's what to do when you get pulled over.

DO:

  • Be polite and respectful
  • Keep your hands visible(if at night turn on lights)
  • Document encounters immediately (you can even record! -- Police should allow you to record them as long as you do not break any other laws... especially if you make them aware of your recording)

DON'T:

  • Answer questions if you do not feel comfortable
  • Give false documents
  • Lie
  • Argue, resist, flee, or obstruct


Watch out for TRICK QUESTIONS:

Trick Question: “Have you had any alcoholic beverages tonight?”

  • Best Answer: “Respectfully officer, I don’t have to answer that.”

Trick Question: “Refusing to answer my question is considered suspicious. Why are you resisting?”

  • Best Answer: “I’m not ‘resisting. I do not have to answer anything.” - This is your 5th amendment right!

Trick Question: “If you have nothing to hide, you shouldn’t mind if I look around, will you?”

  • Best Answer: “I’m sorry officer, however I don’t consent to searches.” - This is your 4th amendment right!


Please remember: 

Refusing a search without a valid warrant or refusing to answer a question which may be incriminating is not labeled as admissions of guilt and is your right.

Most avoidable arrests occur from an individual consenting to a search or admitting guilt, this may come as a result of police having the ability to legally lie, bluff, and intimidate you to obtain information.
