Can Both Criminal and Civil Cases Follow a Fatal Crash in Milwaukee, WI?

When a driver is taken into custody after a fatal pedestrian crash in Milwaukee, two separate legal processes usually move forward at the same time: a criminal case brought by prosecutors and a civil claim pursued by the family.

On one hand, a criminal case focuses on whether a driver broke the law and can result in penalties such as fines or jail time, but it does nothing to cover a family’s financial losses.

On the other hand, a wrongful death claim addresses funeral costs, lost companionship, and the sudden loss of a loved one’s support. This claim can be brought by a surviving spouse, children, or a personal representative of the estate.

These two cases don’t always move at the same pace, and a pending criminal review can sometimes delay how quickly civil evidence becomes available. In that case, a lawyer becomes useful since they can monitor the criminal proceedings for information that strengthens the civil claim while independently gathering police reports and witness accounts.

When it comes to a wrongful death claim, a very important point to understand is Wisconsin’s modified comparative negligence rule. Under this system, a family’s recovery could be reduced if the victim is found partially at fault, though not eliminated.
