What Wrongful Death Claims Look Like When a Motorcyclist Is Killed in Milwaukee, WI
When a motorcyclist dies in a crash, Wisconsin law allows certain family members, typically a spouse, children, or parents, to bring a wrongful death claim against the at-fault driver. This is separate from any criminal charges the driver may face, and it exists specifically to address the financial and personal loss a family experiences when someone is killed.
The sudden death of a family member brings more than sorrow. Wisconsin’s wrongful death statute is intended to cover the loss of the companionship and support that person provided and the immediate funeral and burial expenses and loss of the rider’s future income that families typically incur.
When a case involves a driver taken into custody, the criminal case that moves may eventually produce evidence, such as toxicology results or citations, that also matters in the family’s civil claim. A Milwaukee personal injury attorney can help a family track that criminal process while pursuing a wrongful death claim on a separate timeline, since the two cases don’t have to move in lockstep.
