What Is the Deadline to File an Injury Claim in Milwaukee, WI?

In Wisconsin, a personal injury lawsuit generally must be filed within three years of the date of injury. However, claims against a government body follow a stricter path, because written notice of the claim generally must be given within 120 days. If you miss either deadline, it can limit or end a claim, so the dates are worth confirming early.

The clock generally starts on the date of injury, not the date treatment ends. A person can still be recovering, waiting on test results, or talking with an insurer while the deadline keeps counting down. The 120-day notice is the shortest window, and it can pass before a person has even decided whether to pursue a claim.

In Milwaukee and across Milwaukee County, drivers can face claims that involve several drivers or insurers, and sometimes a government body, which brings the shorter notice rule into play. Working out which deadline applies, and who must receive written notice, takes a close look at the facts. A Milwaukee personal injury lawyer can identify every party who may be responsible, prepare the required notice, and keep each date on the calendar while the person focuses on recovery.
