What Should Cyclists Know About Their Rights After a Crash in Milwaukee, WI?

A cyclist injured by a vehicle in Wisconsin generally has the legal right to pursue a personal injury claim against the at-fault driver, regardless of whether the driver was cited or charged. This applies even when the cyclist was riding lawfully on a public road, since Wisconsin law treats bicycles as vehicles entitled to the same right of way as motor vehicles in most circumstances.

After a crash, an injured cyclist may be able to file a claim for medical expenses, lost income, pain and suffering, and, in more serious cases, a claim for long-term or permanent impairment, depending on the circumstances in which the accident occurred. If a vehicle’s driver was distracted, speeding, or failed to yield, that information can play an important role in supporting the claim and showing how the crash occurred.

Bicycle crashes have become more frequent across Wisconsin in recent years. In 2024, one bicyclist in Wisconsin was killed or injured every 11 hours, with eight cyclists killed and 787 injured statewide that year. That total of roughly 894 bicycle crashes statewide. While this data reflects statewide trends rather than figures specific to Milwaukee, it points to a pattern of rising risk for cyclists sharing the road with vehicles across Wisconsin.

People struck by a vehicle while cycling often suffer injuries to their arms, legs, or joints, along with cuts, bruising, or fractures, depending on the force of impact. Recovery can involve physical therapy and time away from work, particularly when injuries affect mobility.

A Milwaukee personal injury attorney can help a cyclist gather evidence such as the police report, photos of the scene, and witness information to help determine what happened and who may be responsible. Legal guidance can help clarify what options may be available to support medical treatment and recovery costs.
