What Compensation Can a Motorcyclist’s Family Pursue After a Fatal Crash in Milwaukee, WI?

When a motorcyclist is killed in a highway crash, the family left behind may be entitled to pursue a wrongful death claim against any party whose negligence contributed to the accident. In Wisconsin, that claim can be brought by a spouse, children, or other dependents of the deceased. Families can seek compensation for funeral expenses, loss of financial support, and the loss of companionship that the family will carry going forward.

The window to file such a claim is generally three years from the date of death, which is why it is critical to gather evidence well before that deadline.

The Marquette Interchange is one of the most complex and heavily traveled junctions in the state, where I-43, I-94, and I-794 converge in the heart of downtown Milwaukee. The layered ramp system and high traffic volumes make it a particularly unforgiving environment for motorcyclists, who have far less physical protection than occupants of enclosed vehicles. In fact, the Wisconsin Department of Transportation reported 1,805 injured motorcycle crashes and 102 fatalities in 2024.

Fatal motorcycle crashes often involve complex questions of fault, and insurance carriers rarely make the process straightforward for grieving families. Because physical evidence from a fatal crash can be lost or altered quickly, a Milwaukee personal injury attorney can move fast to preserve accident reconstruction data, traffic camera footage, and witness accounts before they become unavailable.
